These terms apply when you use kognifi.my, kognifi.training, or our training services. “We”, “us”, and “Kognifi” mean Kognifi Sdn Bhd.
1. Agreement
By using the websites, registering for a course, or accessing the training portal, you agree to these terms and our Privacy Notice. If you register on behalf of an employer or organisation, you confirm you have authority to do so.
2. Our Services
We provide corporate training, courses, assessments, learning materials, and related support. Some courses are HRD Corp claimable. Employers may register their staff as participants. The training portal supports pre-course, during-course, and post-course activities, including assessments and certificates.
3. Registration and Accounts
You must provide accurate information. For employer registrations, the employer is responsible for the accuracy of participant details and for obtaining any necessary consents. Login details are issued after registration. Keep your account details secure.
4. Fees and Payment
Fees are as stated at the time of booking or in the confirmation. Payment is required before or as agreed for the course. E-certificates are issued after we receive payment and the relevant completion criteria are met (for example, attendance and assessment requirements).
5. Course Materials and Intellectual Property
Course materials, content, assessments and related materials are owned by Kognifi or by our licensors.
You may use the materials only during the course and for your own personal reference related to that course.
You may not copy, share, redistribute, or use the materials to train others (including your team or colleagues) without our prior written permission.
6. Assessments, Attendance and Certificates
Certificates are issued according to the criteria for the course (such as minimum attendance and assessment scores). We may withhold or cancel a certificate if criteria are not met or if payment is outstanding. HRD Corp-related forms (for example TEE) must be completed where required for claims or certification.
7. Cancellations and Changes
Cancellation and rescheduling terms are set out in the booking confirmation or course information. If no specific terms are stated, fees are generally non-refundable once the course has started or after any stated cut-off. We may reschedule or cancel a course for operational reasons and will offer an alternative date or refund of fees paid to us where appropriate.
8. Your Responsibilities
You must use the services lawfully, provide accurate information, and not misuse the websites, portal, or materials. You are responsible for your own participation and for any content you submit (for example, workbook activities).
9. Limitation of Liability
To the extent permitted by Malaysian law, we are not liable for indirect or consequential loss. Our liability for any claim relating to a course or the websites is limited to the fees paid to us for that course. Nothing in these terms excludes liability that cannot be excluded under Malaysian law.
10. Privacy
Our collection and use of personal data is described in the Privacy Notice. Both documents should be read together. Contact for privacy or data matters is via the Contact Us Form.
11. Changes
We may update these terms. The current version will be posted on the websites. Continued use after an update means you accept the updated terms.
12. Governing Law
These terms are governed by the laws of Malaysia. Any dispute shall be subject to the exclusive jurisdiction of the Malaysian courts.
